Heavenly Hands Home Care – Terms & Conditions

1. Services Provided

Heavenly Hands Home Care provides non-medical home care services including personal care, meal preparation, companionship, light housekeeping, medication reminders, transportation, and mobility assistance.

We do not provide medical care, skilled nursing services, or emergency services. Clients should contact 911 or appropriate medical providers in the event of an emergency.

2. Client Responsibilities

Clients and/or their representatives agree to:

  • Provide accurate and complete information regarding care needs

  • Maintain a safe, clean, and respectful environment for caregivers

  • Treat all staff with dignity and respect

  • Secure pets or notify staff of any potential hazards

  • Provide at least 24-hour notice for schedule changes or cancellations

3. Scheduling & Availability

All services are scheduled based on caregiver availability. Heavenly Hands Home Care reserves the right to assign or substitute caregivers as necessary.

While we strive to accommodate all requests, same-day or emergency service requests are not guaranteed.

4. Payment Terms

Payment is due either biweekly or monthly, based on the client’s selected billing schedule.

  • Payments must be made on time to avoid interruption of services

  • A late fee of $50 will be applied if payment is not received by the 5th day of the billing cycle/month

  • Continued non-payment may result in suspension or termination of services

  • Heavenly Hands Home Care reserves the right to require deposits for new clients or extended services

Accepted Forms of Payment:

We accept the following payment methods:

  • Check

  • Cashier’s Check

  • Money Order

  • Zelle

  • Credit Card

  • Debit Card

  • Apple Pay

  • Cash App

Please note: Payments made via Cash App may be subject to an additional processing fee.

All returned checks are subject to a returned check fee, and services may be paused until payment is resolved.

5. Cancellation Policy

A minimum of 24-hour notice is required for cancellations or schedule changes.

Cancellations made with less than 24-hour notice may be charged up to the full service rate

Repeated late cancellations may result in service termination

6. Transportation & Liability

Heavenly Hands Home Care may provide transportation services for clients to and from appointments or errands.

Clients agree to follow all safety guidelines while being transported The company is not responsible for delays caused by traffic, weather, or unforeseen circumstances 

While all reasonable care is taken, Heavenly Hands Home Care is not liable for accidents, injuries, or damages that may occur during transportation, except where required by law

7. Limitation of Liability 

Heavenly Hands Home Care and its staff shall not be held liable for: Injuries, accidents, or incidents occurring in the client’s home due to unsafe conditions 

Pre-existing medical conditions or health complications Loss or damage of personal property unless caused by proven negligence 

Clients are encouraged to maintain appropriate homeowners, renters, and/or personal insurance coverage. 

8. Emergency Situations 

In the event of an emergency, caregivers will attempt to contact emergency services and the client’s emergency contact. 

Heavenly Hands Home Care is not responsible for medical outcomes resulting from emergency situations. 

9. Confidentiality & Privacy 

All client information will be kept confidential and handled in accordance with applicable privacy laws. Information will only be shared with authorized individuals or as required by law. 

10. Termination of Services

Services may be terminated by either party with reasonable notice. Heavenly Hands Home Care reserves the right to terminate services immediately if: 

  • There is unsafe working conditions 

  • Non-payment occurs Staff are subjected to abuse, harassment, or inappropriate behavior 

11. Agreement & Acknowledgment

By receiving services, the client acknowledges and agrees to these Terms & Conditions. A signed Service Agreement and Liability Waiver may be required prior to the start of services. 

12. Comprehensive Liability Disclaimer & Indemnification

To the fullest extent permitted by law, Heavenly Hands Home Care, its owners, employees, contractors, and affiliates shall not be held liable for any injuries, damages, losses, or claims arising from or related to: 

  • The client’s pre-existing medical conditions or health complications 

  • Falls, accidents, or incidents occurring within the client’s home or property Unsafe or hazardous conditions within the home environment

  • Transportation services, including but not limited to vehicle accidents, delays, or third-party actions 

  • Actions or omissions of third parties, including family members, medical providers, or outside agencies 

  • Loss, theft, or damage to personal property unless caused by proven gross negligence 

  • Clients acknowledge that all services provided are non-medical and agree to assume full responsibility for medical care decisions and outcomes. ⸻ Indemnification Clause 

The client (and/or responsible party) agrees to indemnify, defend, and hold harmless Heavenly Hands Home Care and its representatives from any and all claims, liabilities, damages, costs, or expenses (including legal fees) arising out of or related to: 

  • The client’s failure to maintain a safe environment 

  • Any inaccurate or incomplete information provided by the client

  • Any actions taken by the client, family members, or third parties 

  • Any use of transportation services provided 

Important Acknowledgment

By accepting services, the client understands and agrees that Heavenly Hands Home Care does not guarantee outcomes and is not responsible for unforeseen incidents, except where required by applicable law.
